("Italiamos"), in its capacity as the owner of the website (the “Website”), provides users with this document (the “Legal Notice”), with the aim of complying with the obligations set forth in Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, “LSSI”), as well as informing all website users of the conditions of use.
Any person accessing this website assumes the role of “User,” committing to the strict observance and compliance with the provisions outlined here, as well as any other applicable legal provision.

2. CONDITIONS FOR ACCESS AND USE OF THE WEBSITE

Italiamos guarantees the free access and use of the Website. Some services may be subject to prior contracting of the service.
The User guarantees the authenticity and truthfulness of all data provided to Italiamos and will be solely responsible for any false or inaccurate statements made.
Additionally, the User must use the Website in accordance with the applicable legal conditions, as well as with due respect for the terms of use established by Italiamos.
In this sense, and by way of example, but not limited to, the User will refrain from:
I. Using the Website’s communication channels (i.e., reservation form, customer support chat, or contact form) in an unlawful manner and/or to spread illegal, violent, pornographic, racist, xenophobic, offensive, terrorist, or otherwise unlawful or public order contravening content.

3. DATA UPDATE

Italiamos expressly reserves the right to unilaterally modify, in whole or in part, this Legal Notice, without this generating any obligation to notify or communicate with the Website Users, being sufficient the update on Italiamos’ Website.
Despite providing Users with updates of this Legal Notice, the User acknowledges and agrees that it is their responsibility to review the current Legal Notice with each interaction with the Website.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The Website, including, but not limited to, its programming, editing, compilation, and other necessary elements for its operation, designs, logos, text, and/or graphics, are the property of Italiamos or, if applicable, licensed or expressly authorized by the authors.
All contents of the Website are duly protected by intellectual and industrial property laws, as well as registered in the relevant public records. Regardless of the intended purpose, any total or partial reproduction, use, exploitation, distribution, or commercialization requires prior written authorization from Italiamos. Italiamos does not grant any license or authorization to use its intellectual and industrial property rights or any other property or rights related to the Website, and in no case will access or browsing by Users imply a waiver, transfer, license, or assignment, in whole or in part, of those rights by Italiamos.
Any unauthorized use by Italiamos is considered a serious breach of the intellectual or industrial property rights of the author. Designs, logos, text, and/or graphics belonging to third parties and appearing on the Website belong to Italiamos. Italiamos reserves the right to take legal and extrajudicial actions against the User.
Italiamos expressly authorizes third parties to directly link to specific contents on the Website, and in all cases, to redirect to the main italiamos.com Website. Italiamos acknowledges the corresponding intellectual and industrial property rights in favor of its holders, with their mere mention or appearance on the Website not implying any rights or responsibility over them, nor any endorsement, sponsorship, or recommendation from Italiamos.

5. DISCLAIMER OF LIABILITY

Italiamos will not assume any kind of responsibility (contractual or non-contractual, or of any other type) arising from the information published on the Website to the extent that it has no actual knowledge that this information was published, manipulated, or introduced by a third party outside of Italiamos, or if it did, it acted diligently to remove the data or make access to it impossible.
The User uses the Website at their own risk and is subject to the following disclaimers.

Linking Policy

From the Website, Italiamos allows the User to be redirected to content from third-party websites.
Since Italiamos cannot always control the content introduced by third parties on their respective websites, it does not assume any responsibility for such content. In any case, it will proceed with the immediate removal of any content that might contravene national or international legislation, morality, or public order, proceeding to the immediate removal of the redirection to such websites, notifying the relevant authorities of the content in question.
Italiamos is not responsible for information and content stored, including but not limited to, forums, chats, blog generators, comments, social media, or any other medium that allows third parties to independently post content on the Italiamos Website. However, in compliance with the provisions of Articles 11 and 16 of the LSSI, it makes available to all Users, authorities, and law enforcement, actively collaborating in the removal or, if applicable, blocking of all content that may affect or contravene national or international law, third-party rights, or morality and public order.
If the User believes there is any content on the Website that might fall under this classification, they are requested to notify the Website administrator immediately. This Website has been reviewed and tested to ensure it functions correctly. In principle, it can be guaranteed to operate 365 days a year, 24 hours a day. However, Italiamos does not rule out the possibility of certain programming errors, or that situations of force majeure, natural disasters, strikes, or similar circumstances might make access to the website impossible. Italiamos will not assume any responsibility for blocking or the impossibility of access to the website when it is caused by any of these scenarios.

IP Addresses

The Website servers may automatically detect the IP address and domain name used by the user. An IP address is a number automatically assigned to a computer when it connects to the Internet. This information is recorded in an activity log file duly registered, allowing subsequent processing of the data to obtain statistics that show the number of page impressions, visits to web servers, visit order, access points, etc.

7. APPLICABLE LAW AND JURISDICTION

For the resolution of any disputes or issues related to this Legal Notice and/or the Website, Spanish law will apply, with the parties expressly submitting to the jurisdiction of the Courts and Tribunals of the city of Valencia.

8. OTHER PROVISIONS

Italiamos reserves the right to determine in the future that some services on the Website are governed by independent conditions (which, as appropriate, the User may accept separately) and to modify all or part of the Website’s contents.
All rights and obligations of Italiamos may be assigned to any of its subsidiaries, or in relation to a merger, acquisition, restructuring, or asset sale, or other similar operation. In the case of such a transfer, only the User’s information will be transferred in accordance with applicable laws, and consent will be requested when necessary.
If any provision of the Legal Notice is deemed illegal, invalid, or for any reason unenforceable, that provision will be corrected to the minimum extent necessary to make it enforceable, and if it cannot be made enforceable, it will be excluded from this Legal Notice and will not affect the validity and applicability of the remaining provisions, thus the Legal Notice and the remaining part of our Conditions will remain fully valid and in effect.
